<p>Intelligence-Driven Security: a New Defense Doctrine for Advanced Threats</p>
<p>The SBIC is a group of top security leaders from Global 1000 enterprises convened by RSA to discuss top-of-mind security concerns and opportunities.  In the group’s latest report, “Getting Ahead of Advanced Threats: Achieving Intelligence-Driven Information Security,” the Council advocates for a new defense doctrine for combating advanced threats.  Called “intelligence-driven information security,” this collaborative, big data approach includes:</p>
<p>·         The consistent collection of reliable and actionable cyber-risk data from a range of government, industry, commercial, and internal sources to gain a more complete understanding of risks and potential exposures.<br />
·         Ongoing research on prospective cyber adversaries to develop knowledge of attack motivations, favored techniques and known activities.<br />
·         The growth of new skills within the information security team focused on the production of intelligence.<br />
·         A process for efficient analysis, fusion, and management of cyber-risk data from multiple sources to develop actionable intelligence.<br />
·         Full visibility into actual conditions within IT environments, including insight that can identify normal versus abnormal system and end user behavior.<br />
·         Informed risk decisions and defensive strategies based on comprehensive knowledge of the threats and the organization’s own security posture.<br />
·         Best practices to share useful threat information such as attack indicators with other organizations.</p>
<p><em><strong>“It can be hard to digest having to develop a multi-year plan to learn who your adversaries are and how they’re going to steal from you,” said Tim McKnight, Vice President and Chief Information Security Officer, Northrop Grumman.  “Quarter-by-quarter, you may not see any losses.  It could be years until you see the losses – when all of a sudden, out of the blue, a company in another part of the world becomes the leader in your space, having subsidized itself with your R&amp;D investments.”</strong></em></p>
<p>The Council’s new report lays out a six-step roadmap to achieving intelligence-driven information security:</p>
<p>·         Step 1: Start with the Basics<br />
Inventory strategic assets, strengthen incident-response processes and perform comprehensive risk assessments.<br />
·         Step 2. Make the Case<br />
Communicate the benefits of an intelligence-driven security program to executive management and key stakeholders.  Identifying “quick wins” to prove value out of the gate is essential for gaining broad organizational support, including funding.<br />
·         Step 3. Find the Right People<br />
Look for professionals who can blend technical security acumen with analytical thinking and relationship-building skills.<br />
·         Step 4. Build Sources<br />
Determine what data from external or internal sources would help detect, predict or lessen the chances for a targeted attack; evaluate sources on an ongoing basis.<br />
·         Step 5: Define a Process<br />
Codify a standardized methodology to produce actionable intelligence, ensure an appropriate and timely response and develop attack countermeasures.<br />
·         Step 6: Implement Automation<br />
Find opportunities to automate the analysis and management of large volumes of data from multiple sources.</p>

The borough council had high production storage costs due to the growth of e-mail messages and proliferation of PST files. In addition, it needed to comply with the Freedom of Information Act (FOIA) which requires a multi-year retention policy.</p>

<p><strong>Cohen</strong>: Historically, corporations have not focused on e-discovery requirements, but that has changed since the changes to the Federal Rules of Civil Procedure, and some famous legal cases, including Zublake v. USB Warburg.  Numerous corporations have recently been sanctioned and fined because of their failure to identify, collect and produce electronically stored information (ESI) as required by the rules and the case law.</p>

<p><strong>eDiscovery War Stories</strong><br />
“eDiscovery War Stories: The Dirty Truth from the eDiscovery Trenches” was moderated by James D. Shook, Esq., of EMC expert eDiscovery team.  The panelists were Steven Teppler from Edelson McGuire; Jeff Seymour from Deloitte; and EMC’s own Matt Nelson.</p>
<p>The plan was to talk about what really happens in eDiscovery — how shortcuts are sometimes taken, lawyers and IT people miscommunicate, repositories get missed and even good plans go awry — basically that stuff happens.  The panelist wanted to get these stories out in the open, have input from the audience and discuss why sometimes eDiscovery projects do not go as planned — and learn what can be done better.</p>
<p>In reality, our audience was extremely engaged and active, and we followed their lead.  We covered about 25% of our planned material.  One of our key points was discussing the frequent disconnect between Legal and IT, and how important it is for these two groups to communicate well to insure successful eDiscovery processes.  An audience member thanked James and the other panelists for the best session of the day, saying that for her, the depth of detail and knowledge provided by our panelists was ideal.</p>
<p>In one final twist of irony, the best war story came not from a panelist, but from an audience member!</p>
<p><strong>&#8220;The Future of eDiscovery: Emerging Trends in Law and Technology and How it will Impact your Business”</strong></p>
<p>With eDiscovery pioneers and special guest Robert D. Owen from Fulbright &amp; Jaworski, Farrah Pepper from Gibson, Dunn, &amp; Crutcher, George Socha, Esq., and Andrew M. Cohen, Esq., from EMC, Jake Frazier, MBA, Esq., was in top form to moderate the noted panel.  The session discussed the law, recent cases and rulings, as well as how new technology has impacted the business and law surrounding eDiscovery.  One attendee characterized it session as “powerful and insightful.”</p>
<p><strong>eDiscovery StraightTalk</strong><br />
A topic of discussion at LegalTech was Judge Scheindlin recent opinion.  Kazeon delivers insoght into her opinion in our blog eDiscovery StraightTalk with James D. Shook, Esq., entitled “New Decision Orders Sanctions… But Provides Strong Guidance.” The article discusses the very recent decision by Judge Scheindlin in the Pension Committee vs. Banc of America Securities et. al case. Her decision provides the eDiscovery community with some clear guidance on appropriate litigation hold and collection procedures, as well as a framework for determining when sanctions are appropriate and the level of those sanctions. <p>Bringing eDiscovery in-house<br />
The buzz of the show was the topic of bringing eDiscovery in-house, which attendees were very interested in discussing with EMC Kazeon executives. Although several vendors, including ECM have been championing in-house eDiscovery for several years, the tipping point is happening now, says Kazeon in its blog. Kazeon says http://www.kazeon.com/blog/2010/02/emckazeon-at-legaltech-in-house-is-hot/: &#8220;The question customer should ask is &#8216;With all the sanctions and fines leveled by Judges in eDiscovery cases, can your company provide the support to deploy eDiscovery, manage the complexity of  integrating into our data centers and provide process and legal best practices to support us before, during and potentially after ligation?&#8217; If the answer to this question is anything less than an unequivocal YES then customers must think again about their provider.&#8221;</p>

The first commandment:  <em>Thou shalt exhibit competence and avoid pleading technological ignorance</em></p>
<p>The second commandment:<em> Thou shalt cooperate and be transparent</em></p>
<p>The third commandment: <em>Thou shalt comply with the &#8220;duty of preserve evidence&#8221;</em></p>
<p>The fourth commandment:<em> Thou shalt take meet and confer conferences seriously</em></p>
<p>The 5th commandment: <em>Thou shalt educate thyself (and thine outside counsel) as to thine systems and what is &amp; is not feasible</em></p>
<p>The sixth Commandment:<em> Thou shalt not misrepresent thine systems capabilities or lack thereof</em></p>
<p>The seventh commandment: <em>Thou shalt identify &#8220;inaccessible&#8221; data sources during discovery</em></p>
<p>The eight commandment<em>: Thou shalt cooperate with counsel to conduct search terms</em></p>

			<content:encoded><![CDATA[<p>There is no other city in the world like New York, especially if you in banking or law.  This week at Legal Tech it is all about law&#8230;eDiscovery specifically and the technology which is driving the market.  The exhibit show floor has just closed about 30 minutes ago.  It was a wild day of nonstop briefings with a show burting at the seams.</p>
<p>The big news&#8230;.In-House eDiscovery.  Although several vendors like EMC have been championing In-House eDiscovery for several years, this year is when In-House eDiscovery has come into its own.  Why?  Well, there are numerous reasons&#8230;but let&#8217;s say it is at the tipping point.<br />

In-House eDiscovery is being touted by every company at LegalTech.  The question customer should ask is &#8220;With all the sanctions and fines leveled by Judges in eDiscovery cases, can your company provide the support to deploy eDiscovery, manage the complexity of  integrating into our data centers and provide process and legal best practices to support us before, during and potentially after ligation?&#8221;  If the answer to this question is anything less than an &#8220;unequivocal YES&#8221;&#8230;.then customers must think again about their provider.</p>
