<p>The Northampton Borough Council employs over 1,500 people in a vast range of jobs to serve the 200,000 people who live within the largest borough in England. The borough council had high production storage costs due to the growth of e-mail messages and proliferation of PST files. In addition, it needed to comply with the Freedom of Information Act (FOIA) which requires a multi-year retention policy.</p>

<p>Ogilvy South Africa, an advertising agency, needed to avoid using up all available disk space in their e-mail servers and evolve its e-mail storage strategy to minimize exhaustion of IT resources while reining in costs.</p>

<p><strong>Bentley</strong>: How much do businesses focus on e-discovery requirements now?</p>
<p><strong>Cohen</strong>: Historically, corporations have not focused on e-discovery requirements, but that has changed since the changes to the Federal Rules of Civil Procedure, and some famous legal cases, including Zublake v. USB Warburg.  Numerous corporations have recently been sanctioned and fined because of their failure to identify, collect and produce electronically stored information (ESI) as required by the rules and the case law.</p>

<p><strong>eDiscovery War Stories</strong><br />
“eDiscovery War Stories: The Dirty Truth from the eDiscovery Trenches” was moderated by James D. Shook, Esq., of EMC expert eDiscovery team.  The panelists were Steven Teppler from Edelson McGuire; Jeff Seymour from Deloitte; and EMC’s own Matt Nelson.</p>
<p>The plan was to talk about what really happens in eDiscovery — how shortcuts are sometimes taken, lawyers and IT people miscommunicate, repositories get missed and even good plans go awry — basically that stuff happens.  The panelist wanted to get these stories out in the open, have input from the audience and discuss why sometimes eDiscovery projects do not go as planned — and learn what can be done better.</p>
<p>In reality, our audience was extremely engaged and active, and we followed their lead.  We covered about 25% of our planned material.  One of our key points was discussing the frequent disconnect between Legal and IT, and how important it is for these two groups to communicate well to insure successful eDiscovery processes.  An audience member thanked James and the other panelists for the best session of the day, saying that for her, the depth of detail and knowledge provided by our panelists was ideal.</p>
<p>In one final twist of irony, the best war story came not from a panelist, but from an audience member!</p>
<p><strong>&#8220;The Future of eDiscovery: Emerging Trends in Law and Technology and How it will Impact your Business”</strong></p>
<p>With eDiscovery pioneers and special guest Robert D. Owen from Fulbright &amp; Jaworski, Farrah Pepper from Gibson, Dunn, &amp; Crutcher, George Socha, Esq., and Andrew M. Cohen, Esq., from EMC, Jake Frazier, MBA, Esq., was in top form to moderate the noted panel.  The session discussed the law, recent cases and rulings, as well as how new technology has impacted the business and law surrounding eDiscovery.  One attendee characterized it session as “powerful and insightful.”</p>

<p><a href="../../newsroom2/ediscovery-dummies-authors.php"><strong>Linda Volonino</strong></a> (PhD, MBA, CISSP, ACFE) entered the field of computer forensics and electronic evidence in 1998 with a PhD and MBA in information systems (IS). She’s been a guest lecturer on computer forensics and eDiscovery at the State University of New York Buffalo School of Law, and to attorneys and state Supreme Court justices as part of Continuing Legal Education (CLE). She’s a computer forensics investigator and e-discovery consultant with Robson Forensic, Inc. working for plaintiff and defense lawyers in civil and criminal cases. In addition to standard e-mail and e-document evidence, she’s consulted on cases involving electronically stored information (ESI) from social media sites and handheld devices as part of eDiscovery.</p>
<p>Linda’s coauthored Computer Forensics For Dummies and four textbooks: to on information technology, on on information security, and one on computer forensics. She’s published in academic, industry, and law journals on e-discovery and the need for electronic records management as part of pre-litigation readiness. She’s a senior editor on Information Systems Management and was Program Chair for the 2009 Conference on Digital Forensics, Security, and Law.</p>
<p><a href="../../newsroom2/ediscovery-dummies-authors.php"><strong>Ian J. Redpath</strong></a> holds a Bachelor’s degree from Hillsdale College, a JD from the University of Detroit, and an LLM from the University of Wisconsin. He has 34 years of experience in litigation and has been admitted to practice in the states of Michigan, Wisconsin, and New York as well as the Federal and Tax Courts. Ian is also a former prosecuting attorney. He has published numerous articles on contemporary issues and topics and coauthored several books.</p>
<p>Ian has taught American Jurisprudence at the University of Clermont-Ferrand School of Law in France and lectures regularly on American Law at prestigious MGIMO in Russia. He has extensive national and international experience in developing, writing, and presenting continuing education programs.</p>
<p>Currently, Ian is the principle in the Redpath Law Offices with offices in Buffalo and New York City where he specializes in criminal and civil litigation.</p>
