Metadata Is Closer Than It Appears

Among lawyers, the word metadata is likely to conjure confusion, looks of disbelief, fear and–in rarer cases–a knowing smile. Metadata issues present some of the more vexing technical issues for litigation and e-discovery personnel. With metadata back squarely in the news from Judge Scheindlin’s opinion in National Day Laborer Organizing Network v. United States Immigration and Customs Enforcement Agency, 10 Civ. 3488, (S.D.N.Y., 2/3/11), which held that certain metadata must be included in productions under the Freedom of Information Act, it seems like a good time to revisit the issues.
